Agreement Overview
Welcome to Teether, a service provided by BKDK Corporation, DBA "Teether" (referred to as "Teether," "we," "us," or "our"). These Terms of Service ("Agreement") constitute a legal agreement between you ("User," "you," or "your") and Teether. By accessing or using the Teether website and app (collectively, the "Service"), you acknowledge that you have read, understood, and agreed to comply with this Agreement. Agreement Overview

By using the Service, you acknowledge and agree to the following in regards to your service with Teether:
• No Class Action: You waive the right to participate in class action lawsuits, class-wide arbitration, and class-wide consolidated proceedings.
• No Plaintiff: You waive the right to act as a private attorney general or to represent a putative class of users.
• No Jury Trial: You waive the right to a trial by jury in any dispute.
• Arbitration: Any disputes will be resolved through arbitration administered by the American Arbitration Association (AAA) in accordance with its rules and procedures, except for small claims cases.
• Good Faith Negotiations: Both parties agree to engage in good faith negotiations before initiating arbitration.
• Small Claims Exception: Claims qualifying for small claims court are exempt from the arbitration requirement.
• One-Year Time Limit: You must initiate any arbitration within one year after the claim arises.
1. Service Description and Agreement
Teether is a user-friendly platform designed to assist patients in conveniently booking dental appointments. Users can search for specific dental procedures they require and identify local providers who offer those services. Teether acts as an intermediary, facilitating the connection between patients and dental professionals. The prices associated with each procedure are displayed next to the provider's offerings. In situations where the precise procedure needed is uncertain, providers may charge a consultation fee. This consultation fee covers the assessment required to determine the most suitable course of treatment. Importantly, the amount paid as a consultation fee is credited towards the total cost of the subsequent procedure, should the patient decide to proceed with the treatment recommended during the consultation. It is the providers responsibility to credit this consultation fee towards the subsequent procedure.
2. Payments
Two primary payment options are available:
• Pay Now: Users can opt to pay for their chosen procedure(s) immediately.
• Pay Later: Alternatively, users can choose to defer their payment using convenient lending options like Klarna or other similar services integrated into the Teether platform.
Teether functions solely as a facilitator for appointment bookings and payment processing. It does not provide medical or dental advice, nor does it engage in diagnosing or treatment. Teether's role is centered around connecting patients with local dental professionals, and the platform receives compensation in the form of a percentage from providers for each successfully completed procedure.
3. Limitation of Teether's Responsibility
It is essential to clarify that Teether's responsibilities are limited to acting as a conduit for booking appointments and processing payments. The ultimate responsibility for the quality and outcomes of treatments lies with the dental providers. While Teether strives to ensure accurate procedure information and pricing, it cannot guarantee that providers will adhere to these details precisely. Variations in treatment plans and pricing are possible based on professional judgment and patient-specific circumstances. Teether cannot guarantee the safety or reliability of all providers listed on the platform. In cases of medical or dental emergencies, users are advised to contact emergency services by dialing 911.
4. Modifications
To keep users informed about any changes to the Terms of Service, Teether retains the right to modify this Agreement at its discretion. Users are encouraged to regularly review the Agreement to stay updated on any modifications or amendments. Continued use of the Service following modifications indicates the user's acceptance of the updated terms.
5. Terms and Termination
By downloading the Teether app or utilizing the platform, users enter into a binding agreement with Teether. This agreement remains in effect until either party decides to terminate it. Teether reserves the right to terminate a user's access to the Service at any time, with or without cause. Users should be aware that Teether holds no liability for any suspension or discontinuation of access to the Service.
6. Communications
Users acknowledge and consent to receive electronic communications from Teether. These electronic communications are legally recognized as valid forms of communication, satisfying any legal requirements that necessitate written communication. To create a user account, accurate information must be provided, including email address, home address, and cell number. Users agree to SMS communication and must ensure the provided phone number is accurate. Teether disclaims responsibility for any damages resulting from outdated or inaccurate contact information.
7. Limited Ownership License
Teether grants users a limited, non-exclusive, non-transferable license to utilize the Service for personal, non-commercial purposes. This license is contingent on users complying with the terms of this Agreement. Users must refrain from using the Service for any purpose other than its intended use as outlined in this Agreement.
8. Third Party Terms/Services/Links
Teether's platform may include links to third-party provider information and websites. It's important to note that Teether does not endorse, verify, or assume responsibility for the accuracy of this third-party content. Users are advised to review the terms and conditions of linked websites and to exercise caution and due diligence when interacting with third-party providers.
Teether may not have conducted a comprehensive review of all linked providers, and users should independently verify information before making decisions.
9. Indemnity
Users agree to indemnify and hold Teether, its affiliates, officers, directors, and employees harmless from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from user actions, violations of this Agreement, or third-party claims related to the user's use of the Service.
10. Limitation of Liability
Teether disclaims any liability for damages or losses arising from the use of the Service. Users acknowledge that the Service is provided "as is" and "as available," and Teether assumes no responsibility for any interruptions, errors, inaccuracies, or consequences resulting from the use of the Service.
11. Disclaimers
Teether provides no warranties or guarantees regarding the accuracy, reliability, completeness, or timeliness of the information provided on the platform. Users acknowledge that Teether is not responsible for any interruption of the Service, and no refunds will be provided for procedures in the event of Service downtime.
12. Arbitration and Class Action Waiver
By using the Service, users expressly agree to resolve any disputes or claims arising from or related to this Agreement through binding arbitration administered by the American Arbitration Association (AAA). This arbitration process excludes class actions, class-wide arbitrations, and class-wide consolidated proceedings. Users waive their right to trial by jury and the right to act as a plaintiff or class representative.
Good faith negotiations are encouraged before initiating arbitration. However, users must initiate any arbitration proceeding within one year after the claim arises. Small claims cases are exempt from the arbitration requirement.
13. Prohibited Conduct
Users are prohibited from engaging in any illegal, unlawful, or unauthorized use of the Service. Additionally, users are strictly prohibited from reproducing or replicating Teether's business model, concepts, or features.
14. Miscellaneous
English Language: English is the agreed-upon language for communication and interpretation of this Agreement.
Geographical Limitation: Teether is designed for use within the United States. Any use outside of this jurisdiction is at the user's own risk.
Embargo and Terrorism: The Service is not available for use in regions subject to US embargoes or in countries known to support terrorism.
Eligibility: Users must be 18 years or older to use the Service. If a user is under 18, a legal guardian must agree to the terms of service on behalf of the minor.
Severability: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions remain in full force and effect.
Data Security: Users acknowledge that Teether cannot guarantee the security of data transmitted over the internet or public networks.
Apple and App Store Terms: Users are responsible for complying with Apple's App Store terms and conditions when using the Teether app.
15. Telemedicine
Teether's role is solely as an intermediary connecting users with dental providers. All information, advice, and treatment plans provided by the dental providers are the sole responsibility of those providers. Teether is independent from the medical decisions and procedures conducted by the providers.
16. Reviews and Posted Content
Users are solely responsible for the content they post publicly on the Teether platform. It's important to note that any content shared publicly may be shared by Teether and others. Users are
